These terms and conditions (“Terms and Conditions”) govern the relationship between All In Vacay LLC d/b/a All In Vacay (“All In Vacay” and/or “we/us/our”) and you, the purchaser or traveler (“Client” and “passenger” and “you/your”). By engaging All In Vacay for the purpose of utilizing its travel planning services, you acknowledge and agree to be bound by these Terms and Conditions, as well as any and all other terms and conditions for any service provider(s) applicable to your travel booking, each of which are incorporated herein and form part of these Terms and Conditions.
1. Service Providers
All travel services associated with your travel booking(s) are provided by third parties, including, without limitation, travel suppliers that may include, without limitation, suppliers of air travel, lodging accommodations, ground transportation, cruises and tours (collectively referred to as “Supplier(s)” or “Service Providers”). All In Vacay is not the source or provider of any travel services.
SUPPLIERS ARE INDEPENDENT CONTRACTORS AND NOT EMPLOYEES OR AGENTS OF ALL IN VACAY. WE ARE NOT LIABLE FOR, INCLUDING, BUT NOT LIMITED TO, THE ACTS, ERRORS, OMISSIONS, REPRESENTATIONS, WARRANTIES, OR NEGLIGENCE OF ANY SUCH SUPPLIERS OR FOR ANY PERSONAL INJURY, DEATH, PROPERTY DAMAGE, LOSS, ACCIDENT, DELAY, IRREGULARITY, OR ANY OTHER DAMAGES OR EXPENSES RESULTING THEREFROM, WHETHER DIRECTLY OR INDIRECTLY. WE SHALL HAVE NO LIABILITY AND WILL MAKE NO REFUND IN THE EVENT OF ANY DELAY, CANCELLATION, OVERBOOKING, SCHEDULE CHANGE, CESSATION OF OPERATIONS, LABOR DISPUTE, STRIKE, ACTS OF GOVERNMENT, ACTS OF WAR, TERRORISM, DISEASE, QUARANTINE, WEATHER OR OTHER FORCE MAJEURE EVENT OR OTHER CAUSE BEYOND OUR DIRECT CONTROL (EXCEPT WHERE REQUIRED UNDER APPLICABLE CONSUMER PROTECTION LAW). WE HAVE NO RESPONSIBILITY FOR ANY ADDITIONAL EXPENSE, OMISSIONS, MISREPRESENTATIONS, MISTAKES, DELAYS, OR RE-ROUTING CAUSED BY ANY ACTS OR OMISSIONS OF ANY SUPPLIER OR GOVERNMENTAL AUTHORITY. ANY AND ALL CLAIMS REGARDING ANY PRODUCTS AND SERVICES OFFERED THROUGH ALL IN VACAY ARE LIMITED TO CLAIMS AGAINST THE SUPPLIER OF SUCH PRODUCTS AND SERVICE, NOT AGAINST ALL IN VACAY. WE HEREBY DISCLAIM ANY LIABILITY, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL, CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES, IN CONNECTION WITH PRODUCTS OR SERVICES PROVIDED BY ANY SUPPLIER INCLUDING, WITHOUT LIMITATION, LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, DEATH, PROPERTY DAMAGE, LOSS, ACCIDENT, DELAY, IRREGULARITY OR ANY OTHER DAMAGES OR EXPENSES WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, OR OTHERWISE, OF SUCH SUPPLIERS AND YOU HEREBY EXONERATE US FROM ANY LIABILITY WITH RESPECT TO THE SAME.
2. Relationship
In our role as a travel agent, we act as an intermediary agent and independent third party between you and Suppliers and Service Providers. No other relationship of any kind, including but not limited to, joint venture, partnership, employment, agency, representative, fiduciary, or other similar relationship, is formed between you and us, or any Suppliers or Service Providers, as a result of your use of our travel services. We assist you in finding travel Suppliers, crafting custom travel itineraries and making certain arrangements for travel. In identifying Suppliers and recommending itineraries, we may consider a number of factors, including, without limitation, Supplier availability and your preferences. While we may recommend certain Suppliers and destinations of travel, these are solely suggestions. You retain complete control over all selections made with regard to your custom made itinerary; any and all decisions as to Suppliers and destinations of travel are your sole and exclusive decision and we do not accept any responsibility or liability should you be dissatisfied, for any reason, due to the destinations and Suppliers we may suggest.
3. Professional Planning & Concierge Fees
All In Vacay charges professional fees for custom itinerary design, destination research, concierge services, VIP management, and administrative booking services. All professional planning fees are assessed prior to the research and development of your custom travel itinerary. All planning, research, and concierge fees charged directly by All In Vacay are completely non-refundable, regardless of whether a trip is ultimately booked, modified, or canceled, as they cover the labor, expertise, and time dedicated to crafting your escape.
4. Use of All In Vacay Services, Access and Information for Travel Bookings
You represent and warrant that you are at least 18 years of age and possess the legal authority to engage and make travel bookings through All In Vacay subject to these Terms and Conditions. You agree to be financially responsible for all travel bookings you make with us, whether made on behalf of yourself or for other members of your traveling party. You warrant that all information supplied by you on behalf of yourself, members of your household, members of your traveling party, and/or others for whom you are authorized to transact business with us, is true and accurate. You further agree that should you make any reservations or purchase any travel services for other people, you shall inform those people of all terms, conditions, policies, rules and restrictions that apply. You agree that you will only make legitimate reservations or purchases with All In Vacay Suppliers, and you acknowledge that, without limitation, any speculative, false, or fraudulent reservation is prohibited.
All In Vacay is not liable or responsible for any arrangements made independently of All In Vacay. All In Vacay assumes no responsibility for costs or fees you incur for independent arrangements not booked through All In Vacay, inclusive of, but not limited to, airline, hotel, excursion, and travel protection related charges.
All In Vacay acts solely as the booking agent for the Suppliers on your itinerary. Separate Supplier terms and conditions will apply to your reservation and the purchase of travel-related goods and services selected by you. By booking travel through All In Vacay, you are also agreeing to the terms and conditions of each Supplier selected for your itinerary, and that each Suppliers’ terms and conditions are thereby incorporated herein. You agree that you will abide by any and all terms and conditions set forth by a Supplier associated with your travel itinerary.

5. Right to Correct Errors and Offers Subject to Availability
We reserve the right to correct errors. In the event of any pricing error or omission, we reserve the right to adjust such pricing or make any other corrections. All offers, incentives and Supplier promotions are subject to availability and may change without notice.
6. Payments, Cancellations, and Changes to Bookings
You acknowledge and agree that additional terms and conditions dictated by applicable Suppliers and/or Service Providers shall apply to your reservation and/or purchase of products and services through All In Vacay. You shall abide by such terms and conditions, including, without limitation, payment of all amounts when due and compliance with the applicable Service Provider terms, conditions, policies, rules, and restrictions. You understand that any violation of any such Service Provider terms, conditions, policies, rules, or restrictions, including, without limitation, timely payment, may result in: (i) you forfeiting any monies paid for such reservation or purchase, (ii) cancellation of your reservation or purchase, and (iii) you being denied access to any flights, hotels, or any other products or services. You acknowledge and agree that: (i) Suppliers may change their prices without notice prior to reservation or purchase by you, (ii) Suppliers may change the terms of their policies prior to or after reservation or purchase by you, (iii) you are responsible for reviewing and being familiar with the Supplier’s terms and conditions, policies and rules, and (iv) you are responsible for all charges, fees, duties, taxes, and assessments, including, but not limited to, all reservations and purchases you make through All In Vacay. You acknowledge that some Suppliers may require you to sign a liability waiver or other forms prior to using their services, and you understand that your unwillingness to do so may result in a cancellation of your reservation(s), being denied access to the Supplier’s services, and forfeiting any monies paid for such reservation(s), in accordance with applicable Supplier terms and conditions.
Your reservation/purchase may be non-refundable and non-cancellable. Any cancellation or change, if permitted, is subject to the policies of the Suppliers that you selected. At the time of reservation/purchase, your credit/charge card may be charged the total cost of the Supplier products and services that you selected, including taxes and fees (but excluding any mandatory hotel-imposed charges that may be applicable upon check out from the hotel, and/or any tips/gratuities). If applicable, certain mandatory hotel-imposed charges are payable to the property upon check-out (e.g., mandatory resort fees); any incidental charges that you make during your stay will be charged to you by the property upon check-out, including but not limited to parking, phone calls, internet access and room service. Your reservation/purchase includes the products/services that you selected; therefore, if baggage, seat-selection, or similar ancillary items were not included in those products/services, additional Supplier fees may apply. If you purchased a flight, your flight is not confirmed until ticketed. Once ticketed, the name on the ticket cannot be changed and tickets are non-transferable. If permitted, changes to your reservation/purchase are subject to the policies of the Supplier that you selected. If issued to you, vouchers and other airline credits are also subject to the policies of the Supplier you selected. If permitted, and you choose to change your reservation/purchase, you may incur a change fee and any difference in the fare attributable to the change. If your reservation/purchase is with multiple Suppliers, and if cancellation is permitted by one Supplier and not the other, you will not be refunded for the portion of your trip for which cancellations and/or refunds are not permitted and you may be required to cancel your entire trip. If cancellation is permitted, you may incur a cancellation fee. The amount of the cancellation fee will depend on the policies of the Supplier that you selected. Upon receipt, you are responsible for promptly reviewing your reservation/purchase confirmation/itinerary for accuracy and immediately notifying us of any errors.
You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through All In Vacay. By submitting a credit card authorization form to All In Vacay, you agree to allow All In Vacay to use your payment method to purchase travel products from our Suppliers on your behalf. EXCEPTING IN CASES OF FRAUD, YOU AGREE NOT TO FILE ANY DISPUTE WITH YOUR BANK OR CREDIT CARD COMPANY TO AVOID OR VIOLATE ANY BOOKING TERMS AND CONDITIONS OF ALL IN VACAY OR ITS SUPPLIERS, INCLUDING CANCELLATIONS OR CHANGES OF ITINERARY OR ARRANGEMENTS FOR REASONS BEYOND THE CONTROL OF ALL IN VACAY OR ITS SUPPLIERS. IF YOU ATTEMPT TO CHARGEBACK, REVERSE OR RECOLLECT A PREVIOUSLY AUTHORIZED TRIP PAYMENT, ALL IN VACAY RESERVES THE RIGHT TO COLLECT ALL ADDITIONAL COSTS, FEES AND EXPENSES ASSOCIATED WITH SUCH CHARGEBACK, REVERSAL OR RECOLLECTION, INCLUDING, WITHOUT LIMITATION, ATTORNEY FEES.
All payments for travel are due in accordance with each Supplier’s terms and conditions of booking. Suppliers may require non-US travelers to make payments in United States Dollars. You understand that your failure to make final payment or any violation of a Supplier’s conditions of purchase may result in cancellation of your reservations, in your being denied access to any flights, tours, hotels, cruises, or other travel services, being denied coverage from a policy of travel insurance, and/or in your forfeiting any monies paid for your reservations.
By submitting a credit card authorization form to All In Vacay, you acknowledge and agree that you have read and understood all terms and conditions of All In Vacay and its Suppliers, including, but not limited to, those terms and conditions related to any changes, modifications and/or cancellations of a reservation or purchase for travel. If you decide to cancel or change a confirmed booking or purchase, cancellation penalties may be assessed by All In Vacay and the affiliated Supplier(s). In some cases, there is NO REFUND once a booking is made. You may not be entitled to a refund if you change or cancel your travel plans after confirmation of a booking. Credits issued for modifications or cancellations will be issued by the Supplier directly, and that Supplier retains complete control over the availability of that credit toward a future travel reservation or purchase. Cancellation fees may be charged to the credit card or other payment method you authorized to pay for travel services or deducted from the Supplier’s refund. All In Vacay has no control over the outcome of a change or cancellation, as the reservation or purchase by you is an agreement with a Supplier, and not with All In Vacay. The Supplier retains full control over the circumstances which follow any change or cancellation. ALL CANCELLATION REQUESTS MUST BE SUBMITTED TO ALL IN VACAY IN WRITING, AND MUST BE DATED.
If you decide to change any portion of your confirmed arrangements prior to departure or during your trip, we will attempt to assist you. Certain bookings may not be able to be changed, and you will be responsible for any increases in cost imposed by the Supplier, as well as any All In Vacay or Supplier change fees. All requests for changes to a booking must be made in writing to All In Vacay and must be dated. When tour, cruise or package prices are based on Suppliers’ contract rates, you will not be entitled to any refund for any unused portion of travel.
7. Travel Documents, Including TSA and DHS Acceptable Identification Requirements
It is the responsibility of each Client to obtain and carry a valid Real ID, passport book, visa(s), and all other documents required by applicable government regulations. Passport cards are not accepted for most international travel. When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry acceptable identification in order to board a flight. Acceptable identification can be found at http://www.tsa.gov/ and examples include DHS-designated enhanced driver’s license, US passport, or a foreign government passport.
Certain countries will not admit a passenger if their passport expires within six (6) months of the anticipated date of return. Non-United States citizens may require additional documentation, and you are responsible to make All In Vacay aware when traveling on a passport from a country other than the United States of America. All In Vacay neither controls nor warrants the issuance of visas or approval of visa waivers related to your travel. Should a visa not be issued, All In Vacay is not responsible for lost payments made toward your trip. Please note that rules of each country regarding entry and exit may change at any time.
Children and infants may also require travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities; please see https://help.cbp.gov for additional information. The U.S. Customs and Border Protection Agency requires that for groups of children under age 19 arriving to the United States by land or sea from contiguous territory and traveling with a school group, religious group, social or cultural organization, or sports team, may also present an original or copy of his or her birth certificate, a Consular Report of Birth Abroad, or a Naturalization Certificate. Parental or legal guardian consent must be provided to the supervising adult or group leader in writing prior to the start of the trip.
The name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on your tickets and booking records. You acknowledge that it is your responsibility to ensure that the information provided to All In Vacay, and on your tickets and confirmations, is accurate. Any discrepancy between your reservation and your travel documentation may result in denied boarding or an undue delay at an airport security checkpoint causing you to miss your flight, and any subsequent scheduled travel bookings on cruises and tours.
WHEN YOU RECEIVE YOUR TRAVEL DOCUMENTS, IT IS YOUR RESPONSIBILITY TO REVIEW AND VERIFY ALL INFORMATION FOR ACCURACY. CONTACT ALL IN VACAY IMMEDIATELY IF CHANGES OR CORRECTIONS ARE REQUIRED. IF YOU HAVE NOT NOTIFIED US OF NECESSARY CORRECTIONS TO YOUR RESERVATION WITHIN TWENTY-FOUR (24) HOURS OF RECEIVING YOUR TRAVEL DOCUMENTS, ALL IN VACAY BEARS NO RESPONSIBILITY FOR ANY ADDITIONAL COSTS ASSOCIATED WITH MAKING NECESSARY CORRECTIONS.
In addition to the foregoing, for reservations/purchases of a cruise: You must have both: (i) a valid government-issued photo ID, such as a driver’s license, and (ii) proof of citizenship, such as a passport. The name on the documents must match the passenger’s name on the reservation. If you do not have the required documents, boarding will be denied. Requirements may vary by Supplier and destination; please contact the Supplier for the requirements of the cruise you selected. If you choose to reserve/purchase an air-inclusive cruise package provided by a cruise line as a package, you acknowledge that: (i) the cruise line you have selected controls all flight arrangements, including, without limitation, choice of airlines, flight routing, and time schedules, and (ii) your travel documents, including flight itinerary, will be either emailed or mailed to you approximately two to three weeks prior to your departure date. Some air travel may be provided by a public charter; please refer to the operator-participant contract in your travel documents for additional information. The price of air travel may depend on certain factors including, without limitation, date of departure, departure city, ship, cabin level, class of airfare, and availability. The above limitations with regard to airfare also apply to any vacation package purchased through All In Vacay, in which airfare is included.
8. Individual Entry and Exit Requirements
Each country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or prior criminal offense, contact that country directly for entry and exit requirements. You can visit the US State Department Website for further information about these requirements. See, https://travel.state.gov/content/travel.html. We do not inquire about an individual’s criminal record in the interest of respecting our clients’ privacy. For example, if traveling to or through Canada, individuals with a Driving While Intoxicated (DWI) record or with judgements for unpaid child support should review current entry requirements. See: https://www.canada.ca.
9. Immunizations and Health Screenings
You must have the proper immunizations and health screenings and required documentation of such immunizations and screenings before travel. All In Vacay shall not assume responsibility for the accuracy of health, vaccination, or documentation requirements prior to departure or upon landing at the final destination. In some cases, required inoculations must be recorded by Client’s health practitioner on a valid vaccination certificate, which the Client must carry for proof of inoculation. If you are concerned about taking any medications or receiving certain inoculations, check with your health practitioner BEFORE booking. Check the State Department Web site http://travel.state.gov, for relevant information relating to travel to specific destinations, and the Center for Disease Control http://wwwnc.cdc.gov/travel/ relating to health issues related to travel.
10. Risks and Safety
Travel to certain destinations may involve greater risk than others. All In Vacay urges Clients to remain informed on a daily basis as to current news events, as well as to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on health and safety conditions in various countries and the level of risk associated with travel to particular international destinations can be found at http://www.state.gov, http://www.tsa.gov, http://www.dot.gov, http://www.faa.gov, http://www.cdc.gov, and http://www.cbp.gov. The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens who are traveling to, or living in, a foreign country. STEP allows you to enter information about your upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended and provided by going to https://step.state.gov/step/
BY OFFERING FOR SALE TRAVEL TO PARTICULAR DESTINATIONS, ALL IN VACAY DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. CLIENT’S PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT CLIENT’S OWN RISK.
In the event of emergent health or safety concerns, once All In Vacay has investigated the prevailing situation, All In Vacay shall have the sole and absolute discretion whether to proceed with any All In Vacay escorted trip or private departure, or to make alterations to the itinerary.
11. Hazardous Materials
Federal law prohibits passengers from bringing hazardous materials on the aircraft.
(1) Federal law forbids the carriage of hazardous materials aboard aircraft in the passenger’s luggage or on the passenger’s person. A violation can result in five years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radio- active materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radiopharmaceuticals.
(2) There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in the passenger’s luggage and certain smoking materials carried on the passenger’s person. For further information, each passenger should contact the relevant airline representative(s) on their itinerary. Restrictions on hazardous materials are listed http://www.tsa.gov/traveler-information/prohibited-items.
12. Insecticide Notice
We recommend that you refer to the DOT list of airports in countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft. This list is on the DOT’s website and is updated from time to time: http://www.dot.gov/office-policy/aviation-policy/aircraft-disinsection-requirements.
13. Air Travel, Schedule Reconfirmation, Check-In
All In Vacay recommends that you purchase airfare on your own, separate and apart from any travel reservation procured and reserved by All In Vacay. All In Vacay has no control whatsoever over air travel. Whether you purchase your airfare independent of All In Vacay involvement, or as part of a travel package with a All In Vacay Supplier, your airline ticket is a contract between you and the air carrier, even if you purchase through a All In Vacay supplier. If you purchase air travel through a All In Vacay supplier, you acknowledge and agree that All In Vacay does not have the right or ability to control the operations of independent airlines, and you agree that All In Vacay is not liable for any cancellations, modifications, personal injury and/or property damage which are related to your purchase of air tickets or air travel, including, but not limited to any act, error, omission, injury, loss, accident, or delay caused by any act, error or omission of the airline, including the airline’s failure to deliver services (including, but not limited to, flight cancellations for any reason), partial or inadequate delivery of services (including, but not limited to, flight cancellations and/or modifications for any reason), airline policies including refund or rebooking policies, fees for checked or carry-on luggage, fuel increases, bankruptcy or cessation of operations. All In Vacay shall not assume any responsibility for any air schedule changes and are the determination of the independent airline only.
Airline e-tickets expire a year from issue date unless carrier fare rules in the passenger’s itinerary provide otherwise. Failure to use an airline reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfares. It is recommended that you review the terms and conditions of the airline and/or travel supplier and/or travel insurance carrier for all policies as to airfare.
In rare instances, upon departure from a country, certain departure taxes must be paid in cash only and may vary in price.
Due to enhanced security, it is strongly recommended that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure time for international flights. Reconfirm flight times at least 24 hours prior to scheduled departure time for domestic flights, and 72 hours prior for international flights.
Frequent Flyer mileage accrual is at the discretion of the airline(s). All In Vacay has no liability if accrual of miles or points is denied or if upgrades are not allowed. Many airlines do not permit upgrades on airfare purchased in certain fare classes or when using frequent flyer miles, loyalty status or certificates.
Seat assignments are not guaranteed even after they are assigned, and All In Vacay has no control over airline seat assignments. Most airlines charge a fee to pre book a seat.
When you make your own flight arrangements, All In Vacay will not be responsible for any loss resulting from cancellation or changes in international gateways, itineraries, or travel dates, and cannot assist you with any schedule changes or delays related to air reservations you have made on your own arrangement. It may not be possible to earn frequent flyer or other loyalty points for reservations on your itinerary. With limited exceptions, hotel and airline rewards or points cannot be redeemed for travel arrangements made by All In Vacay.
14. Limitations of Responsibility and Disclosure
All In Vacay acts solely as a booking agent for the Suppliers providing travel services to you and is not the source or provider of any travel service. Each Supplier is an independent entity with its own management and is not subject to the control of All In Vacay. The Suppliers whose names appear in travel documentation are those responsible for providing the travel services purchased, and you consent to the use of those Suppliers. The Supplier may determine that alterations in your itinerary are necessary for any number of reasons, including, but not limited to, severe weather. Any alterations to an itinerary are at the sole discretion of the Supplier, and All In Vacay bears no responsibility for any changes.
ALL IN VACAY DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF INDEPENDENT OPERATORS AND SUPPLIERS. ACCORDINGLY, YOU AGREE THAT ALL IN VACAY IS NOT LIABLE FOR ANY LOSSES (FINANCIAL OR OTHERWISE), PERSONAL INJURY OR PROPERTY DAMAGE, WHICH MAY ARISE OUT OF THESE SERVICES. ALL IN VACAY HEREBY DISCLAIMS ANY LIABILITY WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL, CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY SUPPLIER WITH WHOM YOU HAVE ENTERED INTO A BOOKING OR AGREEMENT AS A RESULT OF YOUR RELATIONSHIP WITH ALL IN VACAY, INCLUDING, BUT NOT LIMITED TO, LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILLFUL ACTS, OMISSIONS OR OTHERWISE OF SUCH SUPPLIER, OR OF ANY SUPPLIER OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, BUT NOT LIMITED TO, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, THEIR CANCELLATION AND/OR REFUND POLICIES, FUEL INCREASES, BANKRUPTCY, OR CESSATION OF OPERATIONS AND OTHER MATTERS OUTSIDE OF ALL IN VACAY’S CONTROL, AND YOU HEREBY AGREE AND ACKNOWLEDGE THAT ALL IN VACAY HAS NO LIABILITY WITH RESPECT TO THE SAME.
ALL IN VACAY RECEIVES COMMISSIONS AND PLANNING FEES FOR TRAVEL TRANSACTIONS. YOU AGREE AND UNDERSTAND THAT ANY RECOVERY FROM ALL IN VACAY WILL BE LIMITED TO THE AMOUNT OF THE COMMISSION AND/OR FEES ACTUALLY RECEIVED BY ALL IN VACAY.
15. Indemnification
To the extent permitted by law, you shall defend and indemnify All In Vacay, and each of our respective parents, subsidiaries, affiliates and each of our officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, causes of action, or demands (including reasonable legal and accounting fees) brought by third parties as a result of, caused by, related to or arising out of your booking through All In Vacay, regardless of whether the claimed injury to the third party was due to your negligence, mistake, omission or error, or the negligence, mistake, omission or error of All In Vacay.
16. Force Majeure
All In Vacay will not be in breach of these terms and conditions or otherwise be liable to you, for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities, including web host and internet service provider, breakdown or malfunction of equipment, destruction of or serious damage to facilities, natural catastrophes including, but not limited to extreme weather events, floods and volcanic eruptions, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy, and any other unforeseen circumstance which is beyond the control of All In Vacay. THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS.
In addition, each of All In Vacay’s Suppliers have terms and conditions which include Force Majeure provisions. In the event that a Force Majeure event occurs, those Suppliers may be entitled to, and may in their sole and absolute discretion, vary, postpone or cancel any itinerary or arrangement in relation to the trip. Payment of any refund to you as a result of the non-performance of any obligations hereunder shall remain in the sole and absolute discretion of the Supplier pursuant to their policies, although All In Vacay shall use its reasonable efforts to secure reimbursement for you where possible.
17. Client Conduct
When you book with All In Vacay, you accept responsibility for any damage or loss caused by you or any member of your traveling party. Full payment for any such damage or loss must be paid directly to the accommodation owner or manager or Supplier immediately. You shall indemnify All In Vacay for the full amount of any claim (also including legal costs) made against us for any damage or loss caused by you or any member of your traveling party. We are not responsible for any costs incurred or fees assessed for a member of your traveling party that is removed from any portion of a trip. You agree not to hold All In Vacay, or any of its related entities, liable for any actions taken under these terms and conditions.
Baggage and personal effects are, at all times, the sole responsibility of you.
Any transportation, possession or use of illegal drugs will result in immediate termination of your trip and may result in prosecution by law enforcement authorities. You are responsible for knowing and observing the licensing laws for drug possession (including prescription and over the counter drugs) for all countries and states you are visiting. Laws may require you to carry a prescription from your doctor.
18. Travel Insurance
ALL IN VACAY OFFERS ACCESS TO TRAVEL INSURANCE TO PROTECT TRAVELERS AND THEIR INVESTMENT IN TRAVEL. UNLESS SPECIFICALLY NOTED, TRAVEL INSURANCE IS NOT INCLUDED IN THE COST OF CLIENT’S ITINERARY TO PROTECT AGAINST THIRD PARTY SUPPLIER DEFAULT/BANKRUPTCY, DELAY, INTERRUPTION, MISSED CONNECTION FOR CRUISES AND/OR FLIGHTS, CANCELLATION, MEDICAL EMERGENCY TRANSPORTATION/EVACUATION & REPATRIATION, BAGGAGE & PERSONAL EFFECTS/LOST LUGGAGE & BAGGAGE DELAY, ILLNESS, JOB LOSS, CHANGE OF PLANS, ACCIDENTAL DEATH AND DISABILITY, TRAVEL ACCIDENT/SICKNESS MEDICAL EXPENSES, AND MORE. PROPER INSURANCE MAY PROTECT YOU FROM FINANCIAL LOSS IN ALMOST ALL CIRCUMSTANCES.
Without appropriate travel insurance, you understand and agree that if you cancel or interrupt your travel for any reason, portions of the trip/tour may not be refunded, and All In Vacay’s and travel Suppliers’ cancellation penalties will apply, resulting in the loss of monies up to the full cost of Client’s travel booking and other related costs. The purchase of travel insurance is not required in order to purchase any other product or service from a Supplier through All In Vacay, however, if you decline to purchase insurance, All In Vacay will require that you execute an insurance waiver. All In Vacay is not a licensed insurance broker, and its advisors are not qualified or authorized to answer technical questions about benefits, exclusions, and conditions of any of the insurance offered, nor evaluate the adequacy of the prospective insured’s existing insurance coverage. An additional charge applies for any travel insurance selected. It is your responsibility to know what your insurance policy covers, and to put alternative coverage in place, if you wish to insure for conditions that are excluded by your policy. ALL IN VACAY CANNOT GUARANTEE THAT ANY INSURANCE PROVIDER WILL APPROVE COVERAGE FOR A CLAIM MADE UNDER THE INSURER’S POLICY AND MAKES NO REPRESENTATIONS ABOUT THE EXTENT OF COVERAGE FOR ANY POLICY IT MAY OFFER OR QUOTE.
19. Reservation of Rights and Changes to These Terms
We reserve the right, in our sole discretion, to change these Terms and Conditions at any time. Updated versions of the Terms will be provided to Clients, will be posted on our website and are effective immediately upon posting.
20. General & Governing Law
The laws of the State of New Jersey govern these Terms and Conditions. You hereby consent to the exclusive jurisdiction and venue of courts in Mercer County, New Jersey in all disputes arising out of or relating to travel bookings with All In Vacay. Notice of any claim against All In Vacay must be submitted in writing to All In Vacay within 12 months after the date of completion of the trip and not later. All In Vacay shall not in any case be liable for damages other than compensatory damages, and you waive any right to claim punitive or exemplary damages. You agree that you may only bring claims in your individual capacity and not as plaintiffs or class members in any class action, proposed or purported class action, or other representative action, regardless of the type of proceeding. You expressly agree to waive and forego any and all rights to bring any such class actions, purported or proposed class actions, or representative actions.
If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect.
These Terms and Conditions (and any other terms and conditions referenced herein) constitute the entire agreement between the Client and All In Vacay with respect to travel bookings made through All In Vacay by any means, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between Client and All In Vacay with respect to communications with All In Vacay. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
21. Arbitration
You or we may elect to resolve any claim of any kind arising from these Terms by individual, binding arbitration administered by the AAA or as selected by the party electing arbitration. If arbitration is chosen by any party, neither you nor we will have the right to litigate that Claim in court or have a jury trial on that Claim. Further, you and we will not have the right to participate in a representative capacity or as a member of any class pertaining to any Claim subject to arbitration. Any arbitration hearing that you attend shall take place in Mercer County, New Jersey unless the parties agree to an alternate venue.
The arbitration proceeding and all testimony, filings, documents, and any information relating to or presented during the proceedings shall be deemed to be confidential information not to be disclosed to any other party. All offers, promises, conduct, and statements, whether written or oral, made in the course of the Claim resolution, negotiations, mediations, arbitration, and proceedings to confirm arbitration awards by either party, its agents, employees, experts, or attorneys, or by the mediator or arbitrator, including any arbitration award or judgment related thereto, are confidential, privileged, and inadmissible for any purpose, including impeachment or estoppel, in any other litigation or proceeding involving any of the parties or non-parties, provided that evidence that is otherwise admissible or discoverable shall not be rendered inadmissible or non-discoverable as a result of its use in the negotiation, mediation, or arbitration.
Both parties will share equally the costs of any arbitration proceedings; however, each party shall be solely responsible for its own attorney’s fees and other related costs.
